Welcome to the Panstoria, Inc., web site (our "Site").  Our Site and the information, materials, graphics, and other content found on our Site (collectively, "Content") have been prepared by Panstoria, Inc. ("Panstoria," "we," or "us") and are provided for informational purposes only and Panstoria does not provide any guarantees or warranties relating to any Content.  Access to and use of our Site and the Content and the services made available on our Site (the "Services") by you, the user of our Site ("you"), are governed by the terms and conditions that you will find below ("Terms of Use").  By using our Site, you are agreeing to abide by all Terms of Use.  If you do not agree to the Terms of Use, you must exit our Site. 

Please note that we at all times reserve the right to modify, update, or remove these Terms of Use at any time.  Each time that you access our Site, you are agreeing to the Terms of Use in effect at that time, as set forth on this page, and our Privacy Policy in effect at that time.  In addition, Panstoria reserves the right at all times to suspend or cancel any account if the account holder violates any of these Terms of Use. 

USE OF SITE AND SERVICES

Use of our Site and the Services requires compatible devices and Internet access and may be affected by the performance of these factors.  High-speed Internet access is recommended for optimal use.  You agree that these requirements, which may change from time to time, are your responsibility.  The Services are not part of any other product or offering, and no purchase or obtaining of any other product shall be construed to represent or guarantee you access to the Services.

You are permitted to link to our Site, but only if you link to the home page of our Site and do not eliminate or obscure in any way the copyright notices and if you notify us that you have permitted or created a link to our Site.  We reserve the right at all times to revoke any permission to link to our Site or to otherwise require any such link to be removed or discontinued. 

USER ACCOUNTS

If you are at least 18 years of age, you may create, at no cost to you, a Panstoria account.  In order to purchase any products through our Site, you must create an account.  No one under the age of 18 may create an account.  In order to create an account you must provide certain information that will be requested by us.  By providing such information you agree that it is complete, accurate, and that you will keep all such information current.  You will be permitted to establish a password for your account when you establish the account and you will be solely responsible for maintaining the security and confidentiality of your account.  Panstoria will not be responsible for any losses arising out of or relating to the unauthorized use of your account.  We will use reasonable efforts to protect information submitted by you in connection with your account and any Services, but you agree that your submission of such information is at your sole risk, and we hereby disclaim any and all liability to you for any loss or liability relating to such information in any way. 

By establishing the account, you grant permission to Panstoria to access the account as necessary for maintenance, for enhancing the Services, or to comply with any legal request or requirement.  A condition to maintaining an account is compliance with all of these Terms of Use and we reserve the right at all times to terminate or deactivate any inactive account or account of a person who has violated any of these Terms of Use, including all information associated with the account.  An inactive account is one that the account holder has not logged into for a period of 700 consecutive days.

User Information

Except as is provided in that Privacy Policy, any ideas, concepts, proposals, or other information that you submit to our Site or to Panstoria ("User Information") will be considered nonconfidential and may be used by Panstoria or disclosed or otherwise made available to other users of our Site or any other party.  You may not submit any User Information to our Site or to Panstoria unless such submission is fully authorized and unless it will not infringe upon any other party's intellectual property rights. 

You agree that Panstoria will have, and you hereby grant to Panstoria, a worldwide, royalty-free, perpetual, irrevocable, sublicenseable, non-exclusive right and license to translate, reproduce, sell, publish, distribute, modify, adapt, display, perform, promote, link to or use, in any form or media, any User Information that you submit to our Site or to us.  We does not endorse any User Information that is submitted to our Site by any other party.

APPLICABLE LAW

Panstoria is located in Dayton, Ohio, and our Site is maintained by us in Dayton.  By accessing or using our Site, from anywhere in the world, you are agreeing that the laws of the State of Ohio apply to the use of our Site and its Content and the interpretation and enforcement of these Terms of Use, without regard to conflicts of laws principles.
